HOGAN WEBINAR: Why You Need to Care About FDA’s Laboratory Accreditation Proposed Rule

FDA recently issued a proposed regulation addressing laboratory accreditation, which was required by FSMA. This proposed rule doesn’t just cover labs. If finalized, the rule could have a big impact on PTNPA members that manufacture food.

At a high level, the rule addresses when companies have to use labs accredited through a new FDA accreditation process, and would require the use of these labs in several situations. In particular, FDA is proposing that use of accredited labs would be required (1) in connection with import detentions and for removal from Import Alert, and (2) if the agency issues a “food testing order,” which can be issued under a wide scope of situations where there is a “suspected” food safety problem (e.g., based on certain environmental testing findings in a food facility). The requirement to use an accredited lab is significant because the labs must send the testing results directly to FDA.
